Terms & Conditions

Effective Date: 28th July 2026

These Terms & Conditions govern all bookings made with JamRock Sailing, a trading name of The Un Agency Marketing Ltd, a company incorporated in Jamaica with its registered office in Kingston, Jamaica ('JamRock Sailing', 'we', 'our' or 'us'). By making a booking, you agree to be bound by these Terms & Conditions.

1. Bookings

A booking is confirmed only once a confirmation email has been issued and any required payment has been received. Bookings are subject to availability and may not be transferred without prior written consent.

2. Payment

Full payment must be received no later than ten (10) days before the scheduled sailing date. If payment is not received, JamRock Sailing reserves the right to cancel the booking. The price is per person and priced in $US. Group bookings are available. 

3. Cancellation Policy

More than 14 days before departure: Full refund less payment processing fees.
Between 8–14 days: 50% refund.
7 days or less before departure: No refund.
Any cancellation within seven (7) days, including a No Show, is not eligible for a refund or credit.

4. Weather & Safety

JamRock Sailing may postpone or cancel any sailing due to unsafe weather, sea conditions, mechanical issues, government restrictions or any circumstance beyond our reasonable control. Guests will receive either a full refund or the option to rebook. The Skipper's decision is final.

5. Participation

Guests may participate in sailing activities under the supervision of the Skipper. Participation is voluntary. All guests must follow the Skipper's instructions.

6. Arrival Policy

Guests must arrive at least thirty (30) minutes before departure. Late arrivals may be treated as a No Show and no refund will be provided.

7. Footwear

Only clean, non-marking soft-soled shoes may be worn on board. The Skipper may request shoes be removed. High heels, boots and hard-soled shoes are prohibited.

8. Guest Limits

A maximum of eight (8) guests may be carried unless otherwise agreed in writing.

9. Swimming

Swimming is permitted only at the Skipper's discretion and subject to weather and sea conditions. Guests swim at their own risk. Children must be supervised. Life jackets to be worn at all times by all swimming participants. 

10. Travel Insurance

Guests are strongly encouraged to obtain comprehensive travel insurance covering cancellation, medical expenses, personal accident and personal belongings.

11. Health

Guests should disclose any medical conditions or mobility issues before departure.

12. Children

Children under 18 must be accompanied by a responsible adult.

13. Alcohol

Responsible alcohol consumption is permitted. Intoxicated or disorderly guests may be refused boarding or removed without refund.

14. Personal Property

Personal belongings are brought aboard at the owner's risk.

15. Photography

JamRock Sailing may use photographs or videos for promotional purposes unless guests advise otherwise before departure.

16. Skipper's Authority

The Skipper has absolute authority over the operation of the yacht and all safety matters. Failure to comply with instructions may result in termination of the trip without refund.

17. Liability

Participation in sailing carries inherent risks. To the fullest extent permitted by Jamaican law, JamRock Sailing and The Un Agency Marketing Ltd shall not be liable for any personal items loss or personal injuries except in cases of proven negligence.

18. Force Majeure

JamRock Sailing shall not be liable for cancellations or delays caused by hurricanes, storms, pandemics, government restrictions or other events beyond its reasonable control.

19. Governing Law

These Terms & Conditions are governed by the laws of Jamaica and subject to the exclusive jurisdiction of the Jamaican courts.
